Terms of Service

These Terms of Service ("Terms") govern your use of Canvasy (the "Service"), operated by Vortex Networks ("we," "us," or "our"). By creating an account or otherwise using Canvasy, you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility

You must be at least 13 years old to use Canvasy. If you are under 18, you should have a parent or guardian's permission to use the Service. We do not knowingly collect information from children under 13, and will delete any account found to belong to a child under 13 upon discovery.

2. Your account

You're responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us right away if you think your account has been compromised. Don't create an account using false information, and don't create multiple accounts to evade a ban or suspension.

3. Your content

You retain ownership of everything you upload to Canvasy. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content solely for the purpose of operating and providing the Service (for example, showing your art to people you've chosen to share it with, or generating thumbnails). This license ends when you delete the content or your account, except for copies already shared with others per your chosen visibility settings, or as needed to comply with law.

You're solely responsible for the content you post. By posting, you confirm that you own it or have the necessary rights to share it, and that it doesn't violate anyone else's rights or these Terms.

When you set your content visibility to public or share it with other users, you authorize those users to view, stream, or interact with your content within the interface of the Service. Unless explicitly stated otherwise (such as under a Creative Commons license), you do not grant other users the right to download, redistribute, or commercially exploit your work outside of Canvasy.

4. Prohibited content and conduct

The following are never allowed on Canvasy, regardless of privacy setting (public, private, or shared with a group). Violating this section results in content removal and may result in an immediate, permanent ban:

We reserve the right to remove any content, and suspend or terminate any account, at our sole discretion — including content that's technically permitted by this list but that we determine is harmful, abusive, or not in the spirit of the community, and including in cases where we're not able to explain our specific reasoning.

5. Copyright (DMCA) policy

Vortex Networks respects the intellectual property rights of others and expects users of Canvasy to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond expeditiously to notices of alleged infringement that are reported to our Designated Copyright Agent.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a written notification containing the following information to our Designated Agent:

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Repeat Infringer Policy: In accordance with the DMCA and other applicable law, Canvasy adopts a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. Privacy

We collect the information needed to run the Service: your email address, the content you upload, and technical information like IP addresses (used for security purposes such as login attempt limiting). We don't sell your personal information.

7. Termination

You can delete your account at any time by contacting us at [email protected] or using the built-in account deletion feature. We can suspend or terminate your access at any time, with or without notice, for violating these Terms or for any other reason at our discretion. We reserve the right to refuse service to anyone for any reason.

8. Disclaimer of warranties

Canvasy is provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee the Service will be uninterrupted, secure, or error-free, or that content will be preserved without loss.

9. Limitation of liability

To the maximum extent permitted by law, Vortex Networks won't be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data or content.

10. Indemnification

You agree to defend, indemnify, and hold harmless Vortex Networks, its affiliates, and its employees from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your content, your use of the Service, or your violation of these Terms.

11. Dispute resolution and class action waiver

To the maximum extent permitted by law, you agree that any legal proceedings to resolve disputes will be conducted solely on an individual basis and not in a class, consolidated, or representative action.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll post the updated Terms here with a new "last updated" date. Continued use of the Service after changes take effect means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Oklahoma and the United States of America, without regard to conflict-of-law principles.
